By downloading, installing, or using any application ("App") developed by MSW Digital LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Apps.

2. Description of Services

MSW Digital LLC develops and publishes mobile and desktop applications for iOS and macOS platforms. Our Apps are distributed through the Apple App Store or directly via our website. Each App's specific features and functionality are described in its respective listing. Some Apps may require authentication via third-party providers (such as Google) to access certain features.

3. User Responsibilities

You agree to:

  • Use our Apps only for lawful purposes
  • Not attempt to reverse engineer, decompile, or disassemble our Apps
  • Not copy, modify, or distribute our Apps or their content
  • Not use our Apps in any way that could damage or impair their functionality
  • Comply with all applicable laws and regulations

4. Third-Party Authentication

Some of our Apps offer sign-in features using third-party authentication providers such as Google Sign-In. When using these features:

  • You authorize us to access the specific data scopes disclosed during sign-in
  • Your use of third-party services is also subject to their terms and privacy policies
  • You can revoke access at any time through the third-party provider's settings
  • We are not responsible for third-party service availability or changes to their services

5. User Data Rights

Regarding your data:

  • You retain ownership of your data
  • Your data is stored locally on your device and is not transmitted to our servers
  • You may request deletion of your data by using in-app settings or contacting us
  • Upon account disconnection or app deletion, all associated data is removed from your device

6. Intellectual Property

All content, features, and functionality of our Apps—including but not limited to text, graphics, logos, icons, images, and software—are the exclusive property of MSW Digital LLC and are protected by copyright, trademark, and other intellectual property laws.

7. Disclaimer of Warranties

OUR APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that our Apps will be uninterrupted, error-free, or free of viruses or other harmful components. You use our Apps at your own risk.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MSW DIGITAL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of or inability to use our Apps.

9. Indemnification

You agree to indemnify and hold harmless MSW Digital LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of our Apps or violation of these Terms.

Our Apps may integrate with third-party services including:

  • Apple services (App Store, HealthKit, iCloud, Apple Watch)
  • Google services (Google Sign-In, Gmail API where applicable)

We reserve the right to terminate or suspend your access to our Apps at any time, without notice, for any reason, including breach of these Terms. Upon termination, your right to use our Apps ceases immediately. Any data stored locally on your device will remain accessible to you.

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of our Apps after such changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.
